Control of Weapons Act 1990 - DECLARATION OF DESIGNATED AREA UNDER SECTION 10D(1)
The Assistant Commissioner, North West Metro, acting as a delegate of the Chief Commissioner of Police under section 10D(1) of the Control of Weapons Act 1990, declares as a designated area in all public places within the City of Melbourne that is within the area bounded by and including:
the intersection of Domain Road and Anderson Street, to the intersection of Anderson Street and Alexandra Avenue, to the intersection of Alexandra Avenue and Olympic Boulevard, to the intersection of Olympic Boulevard and Exhibition Street, to the intersection of Exhibition Street and Flinders Street, to the intersection of Flinders Street and Spring Street, to the intersection of Spring Street and Victoria Street, to the intersection of Victoria Street and LaTrobe Street, to the intersection of LaTrobe Street and Wurundjeri Way, to the intersection of Wurundjeri Way and Collins Street, to the intersection of Collins Street and Spencer Street, to the intersection of Clarendon Street and City Road, to the intersection of City Road and St Kilda Road, to the intersection of St Kilda Road and Domain Road, to the intersection of Domain Road and Anderson Street. For the removal of doubt this area includes Federation Square, Parliament Railway Station, Flinders Street Railway Station, Melbourne Central Railway Station, Southern Cross Railway Station, the Royal Botanic Gardens, Kings Domain and Birrarung Marr. (Road has the same meaning as in section 3 of the Road Safety Act 1986.)
This declaration will operate on:
a. 1600 hours on Friday 09-MAR-2018 to 0400 Saturday 10-MAR-2018,
b. 1600 hours on Saturday 10-MAR-2018 to 0400 Sunday 11-MAR-2018,
c. 1600 hours on Sunday 11-MAR-2018 to 0400 Monday 12-MAR-2018,
d. 1000 hours on Monday 12-MAR-2018 to 2200 Monday 12-MAR-2018.
During these times, members of the police force are authorised to exercise the following powers:
a. in a public place in the designated area, without warrant, stop and search for weapons:
i. any person;
ii. anything in the possession or control of the person;
iii. any vehicle with a person in or on the vehicle; and
iv. anything in or on such vehicle;
b. detain a person or vehicle for so long as is reasonably necessary to conduct a search;
c. seize and detain any item the member reasonably suspects is a weapon; and
d. request a person who is the subject of a full search to disclose his or her identity, and
e. direct a person to leave the designated area if the police officer reasonably believes the person is wearing the face covering primarily to
i. conceal their identity; or
ii. to protect them from the effects of a crowd control substance; and
iii. the person refuses to remove the face covering when requested to do so.
f. direct the person to leave the designated area if the police officer reasonably believes the person intends to engage in conduct that would constitute an affray (s195H Crimes Act 1958) or violent disorder (s195I Crimes Act 1958).
