Control of Weapons Act 1990

DECLARATION OF DESIGNATED AREA UNDER SECTION 10D(1)

The Assistant Commissioner, North West Metro, acting as a delegate of the Chief Commissioner of Police under section 10D(1) of the Control of Weapons Act 1990, declares as a designated area: All public places within the area bounded by and including, the intersection of Domain Road and Anderson Street, to the intersection of Anderson Street and Alexandra Avenue, to the intersection of Alexandra Avenue and Olympic Boulevard, to the intersection of Olympic Boulevard and Batman Ave, to the intersection of Batman Ave and Flinders Street, to the intersection of Flinders Street and Spring Street, to the intersection of Spring Street and Victoria Street, to the intersection of Victoria Street and Latrobe Street, to the intersection of Latrobe Street and Wurundjeri Way, to the intersection of Wurundjeri Way and Collins Street, to the intersection of Collins Street and Spencer Street, to the intersection of Clarendon Street and City Road, to the intersection of City Road and St Kilda Road, to the intersection of St Kilda Road and Domain Road, to the intersection of Domain Road and Anderson Street.

This declaration will be in place for the 2021 Moomba festival from:

• Friday 5th March 2021 from 11am to 11pm;
• Saturday 6th March 2021 from 11am to 11pm;
• Sunday 7th March 2021 from 11am to 11pm.

Please be advised that:

• a declaration is in force pursuant to section 10D of the Control of Weapons Act 1990
• you and/or your vehicle is in a public place that is within a designated area
• police officers and protective services officers on duty at a designated place (as per the Victoria Police Act 2013) are empowered to search you and anything in your possession or control, or your vehicle for weapons
• it is an offence to obstruct or hinder a police officer or a protective services officer on duty at a designated place in the exercise of a power to stop and search a person or a vehicle.

A police officer or protective services officer on duty within a designated place intends to conduct a limited search of you or your vehicle/things for weapons.

1. You are requested to co-operate with that search;
2. You may be requested to remove items of outer clothing such as headwear, scarves, jackets, etc.;
3. You may be searched using an electronic wand;
4. You may be requested to remove items from any bags or pockets;
5. You may be given a “pat down” search.

Whilst within the designated area, a police officer may request that you remove any face covering if the police officer reasonably believes the face covering is being worn primarily to conceal your identity, or to protect from the effects of crowd-controlling substances.  If you refuse to remove the face covering, the police officer may direct you to leave the designated area.

A police officer may also direct a person to leave a designated area if the police officer reasonably believes the person intends to engage in conduct that would constitute an offence under section 195H (affray) or 195I (violent disorder) of the Crimes Act 1958.

It is an offence to fail to comply with any direction to leave a designated area without reasonable excuse.
