DECLARATION OF DESIGNATED AREA UNDER SECTION 10D(1)

The Assistant Commissioner, North West Metro Region, acting as a delegate of the Chief Commissioner of Police under section 10D(1) of the Control of Weapons Act 1990, declares as a designated area in all public places within the area bounded by and including:  

All public places within the area bounded by and including, the intersection of Victoria Street and Swanston Street, to the intersection of Swanston Street and Elgin Street, to the intersection of Elgin Street and Nicholson Street, to the intersection of Nicholson Street and Victoria Parade, to the intersection of Victoria Parade and Clarendon Street, to the intersection of Clarendon Street and Wellington Parade, to the intersection of Wellington Parade and Flinders Street, to the intersection of Flinders Street and Batman Avenue, to the intersection of Batman Avenue and Olympic Boulevard, to the intersection of Olympic Boulevard and Linlithgow Avenue, to the intersection of Linlithgow Avenue and Southbank Boulevard, to the intersection of Southbank Boulevard and Yarra Promenade, to the intersection of Yarra Promenade and Queens Bridge Street, to the intersection of Queens Bridge Street and Flinders Street, to the intersection of Flinders Street and Wurundjeri Way, to the intersection of Wurundjeri Way and Bourke Street, to the intersection of Bourke Street and Harbour Esplanade, to the intersection of Harbour Esplanade and Dudley Street, to the intersection of Dudley Street and Peel Street, to the intersection of Peel Street and Victoria Street to the intersection of Victoria Street and Swanston Street.

The public place area depicted on the map overleaf has been declared in writing to be a “designated area” by an Assistant Commissioner of Police.

That declaration is in force under section 10D of the Control of Weapons Act 1990. The declaration is in place between:

  • Thursday 22nd August 2019 from 7pm to Friday 23rd August 2019 at 12am;
  • Friday 23rd August 2019 from 7pm to Saturday 24th August 2019 at 12am;
  • Saturday 24th August 2019 from 7pm to Sunday 25th August 2019 at 2am;

Please be advised that:

  • you and/or your vehicle is in a public place that is within a designated area
  • police officers and protective services officers on duty at a designated place (as per the Victoria Police Act 2013) are empowered to search you and any thing in your possession or control, or your vehicle for weapons
  • it is an offence to obstruct or hinder a police officer or a protective services officer on duty at a designated place in the exercise of a power to stop and search a person or a vehicle

A police officer or protective services officer intends to conduct a limited search of you or your vehicle/things for weapons.

A police officer may also exercise their power under the Act to request you to remove any article covering your face or direct you to leave the designated area if you refuse to remove the face covering, or if the police officer reasonably believes that you intend to engage in conduct that would constitute an affray under s.195H, Crimes Act 1958 or violent disorder under s.195I, Crimes Act 1958.

  • You are requested to co-operate with that search;
  • You may be requested to remove items of outer clothing such as headwear, scarves, jackets, etc.;
  • You may be searched using an electronic wand;
  • You may be requested to remove items from any bags or pockets;
  • You may be given a “pat down” search.

Attention – Offence

It is an offence under the Act to:

  • obstruct or hinder a police officer or protective services officer in the exercise of a power to stop and search a person
  • fail to comply with a direction given by a police officer to remove a face covering or to leave the designated area.
